Fulton County's Solicitor General won't seek charges against a man accused of throwing a child off a swing at .

Paul Oakes, the husband of a former City Council member, has said he never touched the 4-year-old girl, let alone threw her to the ground.

"Other than the testimony of a 4-year-old child, there are no witnesses as to what the mother of the child claims that Paul Oakes did..." the statement said, according to the WSB-TV report.
