Student Charged With Raping Classmate at Private School

Milton police were notified about the alleged assault after Northside Hospital Forsyth staff members treated the underage girl.

MILTON, GA -- An 18-year-old Roswell resident has been charged with raping an underage classmate at the private school they attend in Milton.

Evan Galicia Smith, 18, has been charged by Milton police with rape and statutory rape charges, said spokesperson Capt. Charles Barstow.

The agency was notified by Northside Hospital Forsyth of an alleged sexual assault that took place after treating a juvenile female at the facility.

Capt. Barstow said officers and detectives were dispatched to the hospital to investigate and were able to determine the alleged assault occurred at Mill Springs Academy, a Milton-based private school.

"After interviewing the juvenile victim and other parties, detectives determined that probable cause existed to pursue criminal charges against the suspect, also a student at Mill Springs Academy," he added.

Smith was arrested on Wednesday, April 26 and is housed at the Fulton County Jail.

Barstow added that at this point, investigators believe the alleged assault was not random, and the victim and suspect "were known to each other."

"There is no indication that any other students at the school have been assaulted by the suspect," he added.

According to its mission statement, Mill Springs Academy "is a values-based educational community dedicated to the academic, physical, and social growth of those students who have not realized their full potential in traditional classroom settings."

Fulton County Jail spokesperson Tracy Flanagan said Smith, also charged with enticing a child for indecent purposes, was denied bond on Thursday and his next court appeariance will be May 11.
