Fulton County DA Paul Howard says that had the case gone to trial, witnesses would have testified they could smell alcohol coming from Solis and that he was obviously drunk.

"They also observed him slide across the seat and get out of the passenger door, pretending that he had not been driving," Howard said in a statement. "Solis was so drunk that when police arrived, he was passed out leaning on the expressway median."

At the time of the accident, Solis was on probation for another DUI in Clayton County where he was found passed out in his vehicle in the middle of the road, drunk, smelling of alcohol, and slurring his words.

Three families came from Illinois to speak on behalf of the victim's family.
