Report: Phillip Sailors, charged in the death of Rodrigo Abad Diaz Ortiz, 22, of Duluth, is expected to plead guilty to manslaughter.

The man who was charged with murder in the 2013 shooting death of a 22-year-old from Duluth in a Lilburn driveway apparently will avoid jail time.
The Gwinnett Daily Post reported Phillip Sailors of Lilburn has accepted a deal that will include him pleading guilty to misdemeanor manslaughter and serving a year on probation.
Sailors was charged in the January 2013 shooting death of Rodrigo Abad Diaz Ortiz, 22, of Duluth at 537 Hillcrest Road in Lilburn, after Ortiz had gotten lost and pulled into the driveway to turn around.

Ortiz died from a bullet wound to the head. He was pronounced dead at 6:10 a.m. on Jan. 27 — the night after the shooting — while in the intensive care unit at Gwinnett Medical Center.
Sailors, 69 at the time of the shooting, is scheduled in court Monday to accept the deal, the Post reported.

Diaz’s family, which filed a civil suit against Sailors in May, has said that GPS took him to Sailors’ driveway by mistake and that he was shot as he pulled away from the home. Sailors apparently viewed Ortiz as a threat and fired at his car, in which three of his friends also were seated (none of the friends were injured).
