Johns Creek police have cited David Brian Stinson, 56, for pointing a gun at another man in connection to the incident, which occurred Dec. 8.
An officer was dispatched to the parking of Home Depot at 5950 State Bridge Road around 5:20 p.m. and met with three people: the driver of a black 2015 Ford F-150 pickup truck, the driver of a white GMC Savana and a passenger inside the van.

According to an incident report released by Johns Creek police, Stinson -- the driver of the truck -- said he was traveling near the intersection of Pleasant Hill Road and Peachtree Industrial Boulevard in Duluth when the van was “merging through lanes and traveling in an aggressive/reckless manner.”
Stinson alleged the van was traveling alongside the truck when the driver of the van, identified as Buford resident Peter Thomas Scrocca, allegedly threw something at his truck.
Stinson said that alleged act made him angry, and he began to follow the truck for “identification purposes,” the report states. He also called the police as he continued to follow the van across the Chattahoochee River and into the Home Depot parking lot.
Once both vehicles stopped in an alleyway inside the parking lot, Stinson told police both Scrocca and his passenger in the van exited the vehicle and began to walk towards his truck “in an aggressive manner.” Fearing for his safety, Stinson said he grabbed a firearm, a Glock 9 millimeter semiautomatic handgun, “and pointed it at the driver of the van,” the report states.
Scrocca also gave police his side of the story. He told authorities he was traveling along Pleasant Hill Road when a truck began to follow his van in an aggressive manner and began flashing its headlights into the van’s rear window. Scrocca told police he made his way to the Home Depot parking lot ”in an attempt to escape the truck driver,” the report states.
Once he pulled into the alley, he realized he had no way to leave, so he parked his van. The truck pulled up alongside the van -- preventing it from leaving or backing up. Scrocca said he got out of the vehicle, and approached the truck to confront the driver. It was then when he noticed Stinson allegedly pointing the handgun at him.
Scrocca was able to use his cell phone to record Stinson allegedly pointing the firearm at him during the time of the encounter, police said.
“The video clearly shows David Stinson pointing a gun at him,” the police report states. Additionally, when police asked Scrocca if he threw anything at Stinson’s truck, the man refused to answer the question and told police he wanted a lawyer.
Scrocca’s passenger, Sergio Rosas, was able to corroborate Scrocca’s version of events to police. However, he told police he could not verify if Scrocca threw anything at the truck, as he was focused on other things.
Stinson’s firearm was returned to him, and he was released on a copy of his charges.
