Arlington Heights Approves Fence Variation

The Village of Arlington Heights bypassed their 5 ft. fence rule to allow pool in a residential area.

As the weather is heating up, temporary pools are popping up around Arlington Heights, however a five-foot fence needs to surround the pool, according to village code.

Gary Lira, who lives on the 2600 block of N. Haddow, wants to add a temporary pool in his family's backyard but his surrounding neighbors all have fences built at four-feet.

Besides Mayor Arlene Mulder, the Arlington Heights Village Board voted yes and granted Lira a variation to a pool to be to be erected without the five-foot fence.

Mayor Mulder had reservations, as she is worried about liabilities to the village and setting a precedent of allowing variations to everyone who wants a pool.

Robin Ward, assistant village attorney, said Arlington Heights has no liability. "It's no risk to the village," she said. Ward explained that if a fence were not surrounding the pool, then the pool would have to come down or be drained.

If Lira's neighbors do decide to take their fence down, he does have the option of building his own fence.
