Man Convicted in Domestic, Trespassing Case
Timothy Monty, who previously had a domestic relationship with the victim, brought a loaded gun to the scene, authorities said.

An Arlington Heights man faces a possible prison sentence after a jury convicted him Wednesday of a domestic offense after he trespassed at a Batavia home, prosecutors said. Timothy M. Monty, 45, was found guilty Wednesday of criminal trespass to residence and domestic battery. At about 5 p.m. on July 13, 2017, Monty tried to enter the victim’s Batavia residence through the garage, according to a need release from the Kane County State’s Attorney’s Office.
After he couldn’t get in through the garage, Monty went to the front door and banged on it while shouting. A person inside the home, unaware of the commotion outside, opened the door, according to the news release.
The victim, who had called 911 shortly after Monty arrived, told Monty not to enter the house, prosecutors said. Monty stepped inside and began to yell at the victim, at one point touching his face to the victim’s face. The victim told Monty to leave the house multiple times before he finally did so.

Police arrived a short time later. Monty, who previously had a domestic relationship with the victim, brought a loaded gun to the scene.
Monty is next expected in court on April 18 for his sentencing. Monty faces a sentence of probation or between 1 and 3 years in prison.

According to Illinois law, Monty is now ineligible for a FOID card and a Concealed Carry License.
Monty remains free on a signature bond.
“This case is similar to so many domestic violence cases, where someone is so angry about his loss of control that he resorts to physical violence,” Kane County State’s Attorney Joe McMahon said. “This was an incredibly volatile situation and the presence of his gun made it that much more dangerous for everyone involved, including the police, and even neighbors. Our community has seen too many incidents just like this one become deadly in an instant.”
