Robin B. Murphy, a resident of Chicago’s Wicker Park neighborhood, an associate general counsel at the Illinois Criminal Justice Information Authority, is the author of “Silence as Self-Incrimination after Salinas v. Texas,” an article which appears in the April 2014 issue of the Illinois Bar Journal, the monthly magazine of the Illinois State Bar Association (ISBA).
After Salinas, non-custodial suspects must expressly invoke the right to remain silent or their silence can be held against them. In the article, the author reviews the case and Illinois state law that provides some evidentiary protection for defendants.
The 32,000-member ISBA (isba.org), with offices in Springfield and Chicago, provides professional services to Illinois lawyers, and education and services to the public through a website (illinoislawyerfinder.com), consumer brochures, and distribution of legal information.
