Cary Resident Questions Legality of Assistant Deputy Clerk

Cary Mayor Tom Kierna said he has no concerns over the illegality of the appointment of Assistant Deputy Village Clerk.

The minutes from last week’s village board meeting were approved with one change.

Cary Trustee Bruce Kaplan suggested that the minutes reflect that the village operates under a Trustee-Village form of government, which is one of five types of governments described in the Illinois Municipal Code.

During open forum, Cary resident Marshall Lowe read excerpts from the Illinois Municipal Code and the Cary Municipal Handbook.

His presentation of excerpts and subsequent argument suggested that Cary’s Village Clerk, Nancy Bragg, has not been given the full responsibilities of her office.

He also suggested that the Assistant Deputy Village Clerk Julie Novak’s appointment was not legal, as she was appointed by the village Administrator rather than the village clerk.

“If the deputy clerk’s appointment is not legal, are any documents signed by the deputy clerk legal?” Lowe asked.

Mayor Tom Kierna responded to Lowe’s argument by affirming the legality of Novak’s signature and authority, and thanked Lowe for his comments.

Following the meeting, Kierna said he had “No concerns” regarding illegality on the part of the Assistant Deputy Village Clerk based on Lowe’s comments.
