Man Sentenced to Prison for 3rd DUI

MCHENRY COUNTY, IL — A 51-year-old Chicago man will serve six years in prison for his third drunken driving offense, authorities said. Ben Smart was found guilty of an aggravated driving under the influence of alcohol charge as part of a negotiated plea deal, according to a news release from the McHenry County State’s Attorney’s Office. Smart was also found guilty in 2011 and 2016 of driving under the influence, which were both Cook County offenses.

The most recent DUI charge stems from a April 15, 2018, incident. On that day, a McHenry County Sheriff’s Office deputy stopped a vehicle driven by Smart, according to authorities, and he was arrested following a DUI investigation.

Smart will serve the most recent six-year sentence concurrent to a prior six-year sentence for a DUI conviction, prosecutors said.
