Prosecutors Granted Access To Cunningham Medical Records

A McHenry County judge has granted prosecutors access to the records as they build a case in the death of 5-year-old AJ Freund.

CRYSTAL LAKE, IL — McHenry County prosecutors will be allowed access to treatment records for Joann Cunningham as they look to build a narrative regarding Cunningham's ability to care for her children, including 5-year-old AJ Freund. Cunningham and AJ's father, Andrew Freund Sr., remain behind bars in McHenry County and are both charged with first-degree murder in AJ's beating death in April.

McHenry County Judge Robert Wilbrandt will allow subpoenas for Cunnigham's treatment records at Norwegian American Hospital in Chicago on March 29, 2018; Mount Sinai Hospital in Chicago on July 16, 2018; and Chicago Behavioral Hospital in Des Plaines on July 23, 2018, the Daily Herald reports.

Cunningham and Freund were arrested on April 24, nearly a week after AJ was initially reported missing on April 18. His body was found in a shallow grave near Woodstock prior to his parents' arrest.

Prosecutors are also seeking medical records or reports from Northwestern Medicine McHenry Hospital and the McHenry County Jail regarding Cunningham's treatment from April 24 to Aug. 7, according to the Daily Herald. In addition, they would like to look at the records for treatment for AJ from a Glen Ellyn doctor and from Lurie's Children's Hospital of Chicago for his entire life, Oct. 14, 2013, through April 15, 2019.
