Settlement Reached over 2007 Drowning at Pheasant Run Resort

A confidential settlement has been reached in one of the longest-running lawsuits in Kane County history. The wrongful death lawsuit, filed on behalf of Javier Gonazalez, of Garden Prairie, Ill., sought unspecified damages from Pheasant Run Resort in St. Charles after Gonzalez, 21, drowned in the resort’s pool in December 2007, according to the Daily Herald.

The lawsuit alleged Pheasant Run Resort was at fault for the drowning of Gonzalez, who was a strong swimmer, because of “safety violations,” the newspaper reports.

Details surrounding the settlement have not been released.

Gonzalez was found at the bottom of the deep end of the pool at about 3 p.m. on Dec. 28, 2007, according to a 2008 Daily Herald article. Gonzalez was at the resort with family and was playing a game in the pool when relatives told police they did not see Gonzalez for a few minutes and went looking for him.
