Developer Requests Extension For Drive-Thru Request On Ogden

Downers Grove village council will review a request to extend the special use permit for a drive-through addition ata 1250 Ogden Ave.

DOWNERS GROVE, IL — A developer is requesting a six-month extension of a special use permit that would allow for a drive-thru restaurant at a mixed-use development at 1250-1254 Ogden Ave.

The special use permit was first granted to TKTKT on March 4, 2025. According to village documents, Indvestia Capital, the petitioner has not secured a building permit, but is actively working to.

Per village zoning, special use permits expire after a year if no building permit has been secured. In such cases, the village may approve two separate six-month extensions.

In a letter to village officials, Indvestia Capital Manager Vick Mehta wrote that the delay was influenced by "circumstances beyond our control," including timing issues with approvals required from the Illinois Department of Transportation.

Mehta initially requested a one-year extension, writing,

"The project remains fully intended to proceed in accordance with the plans submitted to the Village, and the ownership remains committed to complying with all conditions set forth in Ordinance No. 6101. The requested extension will allow sufficient time to finalize state approvals, obtain building permits, and commence construction without the need to restart the zoning approval process."

If the village approves the six-month extension Indvestia Capital will have until Sept. 4 to get a building permit. Should the village decline the extension, developers would have to wait until April 14, 2027, to reapply.

The village council will review the request at its April 21 meeting.
