Contractor Claims Paver Rolled Over Foot, Sues Asphalt Company

Contractor was cleaning paver machine while it was still moving forward at Bensenville job site, lawsuit claims.

A contractor is suing the owners of an asphalt company over claims that a paver machine rolled over his foot.

Eddie Cardona filed a lawsuit on Sept. 24 in Du Page County Circuit Court against Everlast Blacktop Inc. of Elgin.

The company hired Cardona in September 2012 as an independent contractor for an asphalt job in Bensenville.

According to the complaint, Cardona was cleaning the front of the paver during the paving operation when it rolled over his foot, causing severe injuries.

The lawsuit contends that the company was negligent because it permitted unsafe working procedures by placing a worker in front of a paver machine while it was moving forward. Also, the person operating the machine could not see another worker in front of the machine.

The plaintiff alleges that because of Everlast’s careless actions, he has suffered both temporary and permanent disabling injuries. He has also incurred expenses for medical care and lost and will continue to lose wages.

Cardona is asking for $50,000 in damages and legal costs.

The case is being represented by attorney John J. Driscoll of Naperville.
