Man Sues Elmhurst Cops In Hospital Incident

The man is accused of biting an Elmhurst officer and lying that someone shot him.

ELMHURST, IL – A man who was accused of biting an Elmhurst officer and lying that someone shot him sued Elmhurst police last week.

Two years ago, David T. Gibson, 27, of Downers Grove, was arrested on counts of aggravated battery to a police officer, filing a false police report and three counts of unlawful possession of a firearm by a felon.

In a federal lawsuit, Gibson said two Elmhurst officers went to Good Samaritan Hospital in Downers Grove, where he was a patient in a wheelchair. He said they were there to investigate a crime.

According to the lawsuit, the officers struck and grabbed Gibson and threw him out of his wheelchair, seriously injuring him.

The two-page lawsuit said the attack was unprovoked and unjustified. The officers' actions violated Gibson's right to be free from unlawful use of force, the lawsuit said.

Gibson's attorney is John Kennedy of Chicago, who focuses on personal injury law.

Last January, Patch obtained the full police report on Gibson's arrest through a public records request. It was based on an incident on Feb. 28, 2021, and referred to the two officers' visit to Gibson's hospital room.

The lawsuit, however, said the incident was on Dec. 28, 2020.

Photos on Gibson's Facebook page show he has been in a wheelchair for at least a decade.

Patch's story last January detailed the police's allegations against Gibson.

Elmhurst's spokeswoman and Gibson's attorney did not return messages for comment.
