Appeals Court Affirms Ruling to Clear Evanston Cop
Officer Mark Buell had been accused in a lawsuit of profiling an African-American boy during a burglary investigation.

A federal appeals court last week affirmed a trial court’s dismissal of a lawsuit filed against an Evanston police officer accused of profile a 13-year-old boy during a burglary investigation three years ago.
Officer Mark Buell detained the youth, Diwani Greenwell, after a woman reported her home had been burglarized on August 20, 2012 - according to Evanston Now. Greenwell had fit the description of a “young boy, African American, [wearing] cargo kahki shorts, dark brown T-shirt or [a] dark shirt.”
After seeing her son handcuffed, Ava Thompson Greenwell, a journalism professor at Northwestern University, believed her son had been profiled and sued the city and Buell, later dropping the city from the list of defendants in the case.

Diwani was released soon after being detained when the victim could not identify him as the burglar. Someone else was arrested for the crime earlier this year when a fingerprint matched one found at the scene.
