The prosecutor said officers saw a car matching the description of a vehicle in which a man was said to be armed with a gun parked in the lot at Walmart, 7050 S. Cicero Ave., Bedford Park.

Herbert was sitting in the driver’s seat and another person was in the car with him. Police ordered the occupants out of the car, the prosecutor said.

The owner of the car gave police consent to search the vehicle, where they found a loaded Smith and Wesson .38 under the seat where Herbert had been sitting, according to the charges.

When officers went to handcuff Herbert, the prosecutor said he started to fight them.

Inside the gun were 11 live rounds, including one in the chamber. Herbert did not have a FOID card or conceal carry permit, police said.

The assistant public defender told the judge that Herbert is a graduate of Harper High School. His parents were in court.

“I ask myself what does he need a gun for,” Judge Felice said.

Bail was set at $25,000. Herbert was ordered to electronic monitoring and random drug testing should be able to make bond.

Herbert is due back in court May 11 in Bridgeview.
