Widow Files Lawsuit Against Driver in Fatal Kane County Crash

The crash killed Jose F. Quitl, 21. Quitl's family is seeking unspecified damages from Brandon Haller of Elburn.

KANE COUNTY, IL - The family of a 21-year-old Aurora man killed in a two-vehicle crash has filed a lawsuit against an Elburn man, which alleges the driver was negligent, did not take proper precautions and may have been distracted when he crossed into the southbound lanes of Route 31 and collided head-on with the Aurora man’s vehicle.

The Elburn man, Brandon D. Haller, 24, has already been ticketed for improper lane usage in connection with the March 29 crash that killed in Jose F. Quitl, according to the Daily Herald.

The accident occurred at about 10:23 p.m. on Route 31 north of Mooseheart Road in unincorporated Batavia Township--near Mooseheart School, according to police.

Quitl was pronounced dead at the scene. Haller was transported to Delnor Hospital for treatment of what appeared to be non-life-threatening injuries.

Quitl’s widow, Diana Quitl Gonzalez, and their two children have filed the lawsuit and are seeking unspecified damages from Haller, according to the Daily Herald.
