Woman Accused in Smoothie-Poisoning Case Has $175,000 in Bank, Could Get New Attorney

Julia Gutierrez is accused of slipping a sedative into her husband's smoothie. He died in their Geneva home earlier this year.

A 53-year-old Geneva woman accused of killing her husband with poisoned smoothie may soon be swapping out her current legal representation, an appointed public defender, for a new attorney after a judge’s inquiry ended up revealing she had nearly $175,000 in bank accounts, the Aurora Beacon-News reports.

Kane County Judge D.J. Tegeler recently requested Julia Gutierrez, who is currently being held without bail at the Kane County Jail, fill out a form regarding her finances, according to the article. She described herself as self-employed, earning between $7,000 to $9,000 per year, and she referenced four bank accounts, including one she inherited, but didn’t share information about account balances.

The Aurora Beacon-News reports court documents revealed Gutierrez has two bank accounts that have balances totaling $110,000, an investment account with $54,000 in it and a total of $9,000 in another account.

Julia L. Gutierrez, 53, is charged with two counts of first-degree murder in connection with the death of Eduardo Gutierrez, 53, whose body was found in their home on Jan. 28. She is accused of mixing Temazepam, which is a sedative used to treat insomnia, into a smoothie and then giving the drink to her husband, according to police and media reports. Eduardo Gutierrez was unaware of the Temazepam, consumed the drink and died as a result, authorities said.

Gutierrez is expected back in court on July 7 where Teagler said he “will address discharging the public defender,” according to the newspaper.
