Judge Will Hear COD-Glen Ellyn Case August 1

Both sides are to refrain from speaking to the press until then.

The judge in the Glen Ellyn-College of DuPage case will hold off on the village's motion for a temporary restraining order until Aug. 1.

Judge Terence M. Sheen of the 18th Judicial Circuit Court will hear an update from both sides on Aug. 1, a decision that came after a 9 a.m. status hearing Thursday.

Sheen also instructed both sides from speaking to the press until Aug. 1. In a joint statement Thursday, both the college and the village said they would follow the judge’s orders.

On Monday, the village passed a motion that required the college to submit certificates of compliance by Wednesday at 1 p.m. Since the college did not get pre-approval for the buildings in the form of building permits, or inspections for the buildings, the certificates are meant to vouch for the safety of the buildings. The certificates were signed by architects and construction managers that state the buildings meet a list of codes and ordinances outlined in the certificates from the village. 

After a final round of certificates the village would likely issue occupancy permits to the college, allowing students and faculty to use the facilities in time for the new school year in August. If those certificates are not accepted by the village, officials said they would continue to seek a temporary restraining order that would ban anyone from occupying the four buildings.

When the buildings are "substantially complete" the college will need to send over the final round of certificates to the village, and at that time the village will conduct inspections of the buildings. Since the Berg Instructional Center qualifies as substantially complete, the college already sent over the final certificates, and a village inspection is scheduled for Friday, July 22.
