Man Sued For Falling on Child At Indoor Play Area: Lawsuit

Lawsuit alleges man failed to take evasive action to prevent him from falling on kid at Yorktown Center.

A mother is suing a man alleging that he fell and injured her child at an indoor playing area in local shopping mall.

Nicole Svehla filed lawsuits individually and on behalf of her young daughter on Jan. 20 in DuPage County Circuit Court against David Buckwater.

Svehla was visiting the Yorktown Center in Lombard on July 12, 2014. Her daughter was playing on the slide inside the play area.

Buckwater was also near the side apparently watching his own child in the play area, the lawsuit maintains.

As Svehla’s daughter was coming down the site, the lawsuit alleges that Buckwater lost his footing and fell down with his full weight on the child.

The lawsuit maintains that Buckwater was standing too close to the children’s slide and failed to take evasive action to avoid falling on the child.

As a result, Svehla’s daughter was injured. She is asking for $50,000 in damages.

Svehla and her daughter are being represented by Chicago attorney Brian T. Nash.
