Illegal Debt Collecting Charges For Glenview Man

Banned from debt collection in Illinois for "egregious and illegal" practices, Illinois Attorney General says he is at it again.

GLENVIEW, IL — Attorney General Lisa Madigan announced charges against a Glenview man Friday for operating an illegal debt collection business in Illinois.

Nelson Macwan, 46, had been banned from running a debt collection business in the state as a result of a 2012 lawsuit against his former company PN Financial Inc., according to statement from the attorney general's office.

Despite that ban, instituted by a 2015 consent decree, Macwan's new company, New Britain Financial LLC, has continued to operate. He has deposited more than $1.8 million into the company's bank accounts, as the company has been racking up more than 100 consumer complaints around the country, prosecutors said.

“The defendant continued his unlawful debt collection practices after a court prohibited him from operating as a debt collector,” Madigan said, announcing the indirect criminal contempt charges. “His actions are illegal and have harmed people across the country.”

Madigan called Macwan's previous company "one of the most egregious cases of illegal debt collection" and has asked for at least six months in prison for Macwan. The case is being handled by Madigan's Consumer Fraud Bureau.
