Sentencing Delayed in Old Mill Creek Attempted Car Theft
Diamond Davis, 18, of Chicago, will be sentenced on Nov. 5 in Lake County Court, proescutors said.

LAKE COUNTY, IL — The sentencing for an 18-year-old Chicago woman convicted in connection with an attempted car theft that lead to an elderly man fatally shooting a teen outside his Old Mill Creek home has been delayed, prosecutors said. Diamond Davis, of the 5000 block of Martin Luther King Drive, pleaded guilty to criminal trespassing and conspiracy to commit a burglary charges last month.
The sentencing hearing for Davis was continued to 1:30 p.m. on Nov. 5 in Lake County Circuit Court, according to a news release from the state's attorney's office. The delay was requested during a brief appearance Thursday because the author of a pre-sentence investigation report needed another week to finish it.
The previous sentencing hearing had been scheduled for Oct. 18, according to the news release.

Davis, 18, of the 500 block of Martin Luther King Drive in Chicago, remains in custody at the Lake County Jail on a $1 million bail.
She was ordered to remain held on a $1 million bail until her sentencing and faces up to three years in prison for a felony conspiracy to commit burglary charge and up to one year in jail for a misdemeanor criminal trespass to motor vehicle charge, according to a news release from the Lake County State's Attorney's Office.

Meanwhile, four other co-defendants who allegedly worked with Davis and the teen who was fatally shot to try to steal the man's vehicle, are charged in juvenile court. Those cases are ongoing, prosecutors said.

The group allegedly went to the home in 17600 block of West Edwards Road in Old Mill Creek at about 1:15 a.m. on Aug. 13. The homeowner, a 75-year-old licensed firearm owner with a permit to carry a concealed weapon, told investigators he noticed a suspicious black SUV in front of his house and a group of people that appeared to be trying to break into his car, police said.
Armed with a small-caliber revolver, the homeowner went outside to investigate what was going on and shouted at the group to leave, according to authorities.
"The homeowner indicated that as he was standing on his porch, there were two male individuals who quickly approached him on his property at his porch. One of those individuals was holding something in his hand. The 75-year-old homeowner indicated that out of fear for his safety and his wife's safety, he discharged his firearm," Sgt. Chris Covelli said. "What we've determined is one of the rounds that was discharged from his firearm did strike this 14-year-old male in the head."
Four other teens, all boys under the age of 18, were originally charged in adult court but those cases have since been transferred to juvenile court, authorities said.
