Louis Joliet Mall Sears Sued For Negligence

Their plaintiff is Carolyn Hallen.

JOLIET, IL - The past few years have brought plenty of bad news to Sears as more of its stores go out of business. So far, the Joliet Sears at the Louis Joliet Mall has weathered that storm, but the Joliet Sears on Mall Loop Drive now finds itself embroiled in a new civil lawsuit. The case was filed this week at the Will County Courthouse. The plaintiff is Carolyn Hallen. She is represented by attorney Aretha Bright from the Vrdolyak Law Group's Tinley Park location.

The negligence lawsuit names as defendants, Sears, Sears Roebuck and Co., and Sears Holdings Management Corp.

Hallen wants a Will County jury to award her more than $50,000 in monetary damages, plus the costs of bringing the lawsuit. Hallen's troubles began when she patronized the Sears store two summers ago, on June 27, 2016.

"The Plaintiff was then and there lawfully upon said premises when she did suffer injuries … due to an unreasonably dangerous condition on the premises … Plaintiff was knocked over by a Sears employee due to the placement of the refrigerators in the store," Vrdolyak Law Group informed the court.

The lawsuit alleges that their client "suffered injuries and damages of a personal, pecuniary and permanent nature."

Sears is accused of disregarding the plaintiff's safety by creating and allowing for an "unreasonably dangerous condition to remain at said premises through defendant's negligence."

Slip and fall lawsuits have been on the rise of late at the Will County Courthouse. Earlier this week, Patch wrote about a New Lenox American Legion Veteran who is now suing the Kurtz Memorial Chapel in New Lenox for having a dangerous and uneven sidewalk.

And last week, Patch wrote about Joliet attorney Frank Cservenyak's lawsuit he filed on behalf of client of Anthony Arrington Jr. against the Joliet YMCA on Houbolt Road.
