Mooyah On Jefferson St. Sued By Customer
The civil lawsuit was filed by Rathbun, Cservenyak and Kozol, one of Will County's largest law firms.

JOLIET, IL — It's been two years since customer Dan Davies visited Joliet's Mooyah burger restaurant on West Jefferson Street. As a result of that experience, Davies has hired one of Will County's largest law firms, Rathbun, Cservenyak and Kozol, to the sue the fast-food restaurant surrounding the injuries he suffered as a result of a fall, court documents indicate.
The negligence lawsuit filed at the Will County Courthouse indicates that Mooyah is based in Oak Park and does business as Jeffcat, LLC, and Betta Burger Group. Jeffcat owns and managed the outdoor seating seat at 2611 West Jefferson St. in Joliet and the adjoining premises at 2613 W. Jefferson St. and 2609 W. Jefferson St.
"In the evening of Nov. 24, 2017, plaintiff Dan Davies was a customer and business invitee of defendant, Mooyah, and he was lawfully on the premises," his lawsuit states. "On the above day and location, plaintiff Dan Davies was then caused to trip, stumble and fall due to a table stand that protruded out in defendant's designated outdoor seating area."

The lawsuit accuses Mooyah of nine separate acts of negligence or carelessness including having "failed to warn the plaintiff of the dangerous condition of said outdoor seating area, when the defendant knew, or in the exercise of ordinary care should have known, that said warning was necessary to prevent injury to plaintiff."
Plaintiff's attorney Frank Cservenyak has asked that a Will County jury issue a judgment in favor of his client in excess of $50,000, court files show.

Lawyers for Mooyah have yet to file their response to the lawsuit.
