Nacho Cheese Dip Leads To Thorntons Lawsuit

JOLIET, IL — A new slip and fall lawsuit filed this week against the Thorntons gas station at 2798 West Jefferson St. accuses the Joliet business of being negligent with its nacho cheese dip. The lawsuit was filed by Joliet attorney Bill Cassian on behalf of his client, Phitsamay Namathep.

Namathep was patronizing the Thorntons on April 12, 2018 and she "was walking in the area where customers could obtain heated nacho cheese dip," according to Cassian & Carter, a Joliet personal injury law firm.

While inside the gas station convenient store, Namathep "was caused to slip on a nacho cheese dip that had been left in the walkway causing her to fall to the ground," court records state.

The lawsuit seeks a judgment from a Will County judge and jury in excess of $50,000.

Cassian listed five allegations of carelessness and negligence against Thorntons including having "failed to follow its policies and procedures to perform safety sweeps in the area of the fall to ensure that the walkways were clear for persons walking thereon although they knew or should have known of the propensity for substances like nacho cheese dip to be spilled in the walkways."

Furthermore, Thorntons "failed to promptly clean up the nacho cheese dip spill when it had actual knowledge of the same and instead chose to wait to clean said spill because, according to an employee oral statement just after the fall, employees had been 'too busy' to clean it up," the plaintiff's lawyer argues.

As for Namathep, her "foot came into contact with the nacho cheese dip on the floor and she was caused to fall on the ground, suffer bodily injury and mental anguish and suffering and to incur medical expenses for treatment of said injuries," Cassian notified Will County's court.

The lawsuit indicates the plaintiff currently resides in Plainfield.
