Man, 61, Accused Of Using Key Fob Camera To Take Pics Of Kids In Walmart Won't Stand Trial—Yet: Judge

An evaluation determined that the man—a registered sexual predator—is currently unfit, but will undergo treatment and be reevaluated.

WILL COUNTY, IL — A Joliet man arrested after allegedly taking pictures of children at a Walmart learned last week he won't face a trial yet, with a judge remanding him to a state-run treatment and a future reassessment of his status.

Paul Raibley, 61, was transferred into Illinois Department of Human Services custody after a Will County judge's review of a psych eval of the sexual predator. Court documents show that psychologist Dr. Alyssa Bell found Raibley unfit to stand trial, and a Will County judge agreed.

The Court ordered the Department of Human Services to assess Raibley for appropriate placement in a secure setting, then to evaluate him further to determine if his condition can be restored to stand trial.

Raibley's lawyer Steven Haney reportedly asked for Raibley to be evaluated due to attempts to take his own life while detained, the Chicago Tribune reported.

Haney declined further comment on that.

The department is required to come back to the court with findings with in 30 days, with a court date set for Nov. 24, at 9 a.m. The report must detail if Raibley's condition rendering him unfit is physical or mental, according to court documents.

New Lenox Police said a man who was later identified to be Raibley was seen taking photos underneath the bottom portion of the clothing of a woman who was shopping there on July 2. An employee confronted him, and he ran.

Raibley is then said to have returned to the store on July 18, police said. Police were called for a report of a man also identified as Raibley taking pictures of children with a key fob device.

According to the Illinois State Police Sex Offender registry, Raibley has a 2007 child porn conviction and must register for life.

Police learned the same Walmart employee who reported the July 2 incident saw Raibley in the store on July 18. Walmart Asset Protection followed Raibley through the store, and "observed him take photos of juveniles with what appeared to be a key fob device." Store video confirmed Raibley was involved in both incidents, police said.

Officers found a small camera disguised as a key fob in Raibley’s possession, according to police.

Investigators obtained search warrants for Raibley’s phone and the key fob camera. Police found videos of adult and juvenile subjects in Walmart from July 18 on the key fob camera. They also found a video of the adult customer from the July 2 incident on his phone, police said. Additional videos on the phone provided evidence indicating that Raibley possessed additional videos at his residence in Joliet.

Investigators obtained a search warrant for Raibley’s home, where they located digital storage devices containing "dozens" of videos of juveniles in public settings, police said.

Raibley was charged with three counts of child photography by a sex offender, and one count of unauthorized video recording. All are felony charges.
