Trial + Error = Appeal

What takes litigation so long to conclude? If there are errors at a trial, the losing party has the right to appeal - more than once.

By celebrity news standards, Anna Nicole Smith is “old news.”  While she is no longer alive, litigation concerning her is.  A reluctant party to this litigation is Howard K. Stern, her former manager and lawyer.  As you may recall, Stern was charged with 11 felonies.  At the close of a jury trial in 2011, he was convicted on two counts of conspiracy. However, these convictions were vacated on the grounds that there was insufficient evidence on both.  

Recently, a California appeals court has ruled against the trial judge and reinstated the convictions.  The case will now return to the trial judge who will have the option to:  1) Sentence Stern to prison; 2) Sentence Stern to probation; 3) Reduce the felonies to misdemeanors; or 4) Dismiss the whole case on other legal grounds.   That is litigation:   “It ain’t over until it is over!”  It might be several more months before there is a final decision for the history books.
