Woman's Breast Augmentation Photos Used Without Permission By Orland Surgeons: Suit

A woman has sued a father and son team of plastic surgeons in the south suburbs for allegedly using photos of her for advertising.

ORLAND PARK, IL — A team of plastic surgeons with an office in Orland Park are being sued after a woman claimed they used before-and-after photos of her breast augmentation surgery as an advertising tool on their website. The woman is known as “Jane Doe” in the lawsuit filed this week in Cook County Circuit Court, according to a Chicago Tribune report. She says she has been “humiliated” by the release of the photos.

Dr. Rajendra Shah and his son Dr. Samir Shah were “specifically refused” to use the photos for advertising purposes, according to the lawsuit. An attorney for the woman says that while she signed a waiver allowing photos to be taken for medical purposes, she crossed off a section of the release that would have allowed the use of them for advertising. The photos were used on the Shahs' website for about a year, and the woman said she suffered "intense fear that her close family members" would recognize them because of a "highly distinctive freckle pattern on her chest," the suit alleges. The woman seeks $50,000 plus costs from the plastic surgeons in the lawsuit.

The Shahs are part of the A New You Plastic Surgery & Laser Center that has cosmetic surgery offices in Orland Park and Oak Lawn. The Orland Park office in which the plaintiff in the lawsuit claims she had the surgery done and photos taken in 2015 is located at 154th and Harlem.

In addition to leading his private practice, Rajendra Shah has been a member on staff at Christ Hospital since 1983, according to the "About" section on the "New You" website.

The photos have since been removed from the Shahs' website.
