The Filling Station Faces Two-Hour Suspension for Liquor Code Violation

The Filling Station, 300 W. Main St., will not be fined but will have its liquor licenses suspended for two hours next month after the establishment was cited Aug. 16, 2013, when two patrons left the premises with drinks in hand.

The city on Monday issued a release on the penalty one week after the St. Charles Liquor Control Commission held a formal hearing on the infraction. At that hearing, commissioners found The Filling Station was in violation of the local liquor ordinances

The two-hour suspension was ordered in lieu of a monetary fine, according to a city release issued Monday. The Filling Station’s liquor license will be temporarily suspended from midnight to 2 a.m. Saturday, Nov. 9, 2013, prohibiting the establishment from serving alcoholic beverages during those hours.

Under the liquor code, penalties could have ranged from as little as $1 to as much as $1,000, plus costs of as much as $500.

The city said the The Filling Station’s last liquor violation was in 2011.

“The penalty supports the city’s desire to promote a safe environment for all in downtown St. Charles,” Mayor Raymond Rogina said in the release.

In September, Peter Mulligan, a managing partner at The Filling Station, asked for a formal hearing on the citation.

The complaint against The Filling Station stems from an Aug. 16, 2013 incident in which two patrons, with drinks in hand, left the establishment’s patio area. The couple told police they left with their drinks after seeing others do so. They were cited with open alcohol.
