Man Accused Of Possessing Gun Illegally In Carol Stream

CAROL STREAM, IL — An Evanston man faces felony charges after police say he threatened someone in the parking lot of the Carol Stream Police Department and was found to be in possession of of a gun as a convicted felon.

Nicolas Mayfield, 31, was charged with armed habitual criminal, aggravated unlawful use of a weapon by a felon and unlawful use of a weapon in connection with the Aug. 1 incident.

Police say a battery victim was walking back to his car at the Carol Stream Police Department when Mayfield got into an argument with him and said, "I'll kill you right here" and implying he had a gun in his waistband.

The victim drove off, but returned later and he and Mayfield got into another argument, police say. Police officers intervened and the victim told them Mayfield had threatened him.

Police got permission to search the car Mayfield was a passenger in and say they found a loaded .40-caliber Smith and Wesson handgun that had a bullet in the chamber.

An investigation led officers to link the gun to Mayfield. A warrant was issued on Aug. 5 and Mayfield was later taken into custody. He is currently being held in DuPage County Jail on $250,000 bond.

“As a convicted felon, Mr. Mayfield is prohibited from ever owning or possessing a firearm,” DuPage County State's Attorney Robert Berlin said in a statement.

He added, “It is alleged however, that instead of conducting himself within the legal limitations placed upon him due to his multiple felony convictions, Mr. Mayfield thumbed his nose once again at the law and decided to not only illegally arm himself, but also threaten to kill another human being. As I have said before, we will use every tool at our disposal to aggressively pursue and hold accountable anyone who would commit a crime while in DuPage County."

Mayfield is scheduled to appear in court again on Sept. 29.
