Wheaton Man Gets 16 Years For Sexually Assaulting 2 Women

WHEATON, IL — A Wheaton man has been sentenced to 16 years in prison after he sexually assaulted two women who were unable to give knowing consent, according to the DuPage County State's Attorney's Office.

Matthew Tumbarello, 21, of the 200 block of W. Illinois Street, pleaded guilty to two counts of criminal sexual assault — unable to consent, in March 2022.

Authorities say Tumbarello sexually assaulted a woman he was dating in July 2020 while she was intoxicated, a news release said. A subsequent investigation led police to learn that Tumbarello had also sexually assaulted another woman while she was intoxicated on a separate occasion.

A warrant was later issued for Tumbarello's arrest. He appeared in bond court in late July 2020 and was released the same day after posting bail.

“An individual’s inability to refuse having sex is not consent,” DuPage County State's Attorney Robert Berlin said in a statement.

Berlin added, “The fact that Mr. Tumbarello took advantage of two women who were unable to consent is reprehensible. I thank the two victims in this case for their courage to step forward and willingness to assist us in holding Matthew Tumbarello accountable for his despicable actions.

Tumbarello must serve 85 percent of his sentence before he becomes eligible for parole.
