
The proposed $34 million Willow Road stormwater tunnel project in Winnetka is the basis for a lawsuit filed by one man against the village of Winnetka seeking class-action status.
Winnetka resident Mark Green filed the suit in Cook County Chancery Court last week claiming local property owners should not be forced to pay a utility fee to help support the project, the Winnetka Talk reports.
The suit calls the fee “a disguised property tax” and says it is an “improper use of Winnetka’s taxing authority.”

Green’s attorney, Todd McLawhorn, said the litigation is “on behalf of all those in Winnetka who own property that has been assessed by the stormwater fee.”
“I don’t mind the extra dollars coming from me if they do it through the proper channels,” Green said.
