Police Report of Acton Family Network Embezzlement Case
The following information was supplied by the Concord District Court. Where arrests or charges are mentioned, it does not indicate a conviction.

On March 13, 2012, the Acton Police Department received a phone call from Alycen Nigro of Acton, wishing to speak with a detective about a past larceny involving the Acton Family Network (AFN) from 2007-2008, a local nonprofit run by parents to help local resources for families with children. Nigro is the Chair person for the AFN and said she saw a concerning Kimberly Clark and her husband Kevin, regarding charges of embezzling from the Cub Scouts; Kimberly was treasurer for Cub Scouts packs 1 and 70 from 2005-2011 and she was treasurer for the AFN from 2006-2008.
Nigro told police she found "many debit card transactions that had no explanation or corresponding event by the AFN." She also noticed an AFN check was made out to the Acton Cub Scout pack 70 for $800.00, signed by Kimberly Clark. Nigro was surprised to see the debit card was used for transactions to a doctor, a pay pal account, a veterinarian and many other odd places.

On May 4, 2012, Kimberly Clark and her attorney John McNamara met with Acton Police Detective Christopher Browne to discuss the AFN debit card transactions.
• Kimberly told Browne that the May 22 transaction at Atir Natural Nail for $66.00 was from an AFN "moms night out."
• Kimberly told Browne that she had no idea about the Verizon Pay By Phone transaction because it is not the bill amount she pays for her family.
• Regarding many of the ATM withdrawals, Kimberly told Browne that she would make many purchases for AFN events and never used the debit card for personal use.
• Kimberly told Browne she "could not imagine it was her" who purchased $118.95 at American Girl on September 4, 2007.
• Regarding the Exxon withdrawals, Kimberly told Browne that the AFN purchased many gift cards for its members.
• When Browne asked Kimberly about the transactions at Supercuts, she said "I honestly do not think so but it was five years ago." And stated that she does not get her haircut there.
• Kimberly told Browne that the only thing "that would be me is the Pediatric of Weston." She stated that her kids go there.
• Regarding the 1800-Contacts transaction for $154.95, Kimberly said she had purchased contacts from them before.
• Kimberly stated that the Great Road Veterinary transaction could definitely be from her.
• Kimberly stated that she had no idea what Lia Sophia Lady Reming is, which was a transaction for $99.98.
• Kimberly stated that she never shopped at the Paper Store or the Fishnook or Petsmart.
• Regarding the Oriental Trading Company purchase for $129.84, Kimberly stated that that would have been for party supplies.
• Regarding the $800 check made to the Acton Cub Scout pack 70, Kimberly said that she wrote the check. And Regarding the $430.00 transaction to the Kate Duffy-Business Dev. Firm, who Kimberly claims was the person who designed the AFN logo, Kimberly said she never paid for that.

On May 4, 2012, Detective Browne had a meeting with Mira Greenland and Vanessa Volinsky, previous chair persons from the AFN during Kimberly Clark's time served as treasurer. Volinsky said that she had a debit card and Kimberly had a debit card for the AFN. Volinsky stated that she personally only used the card once or twice.
- Volinsky said that she could not see any reason for large ATM withdrawals because "very little is paid with cash and if you needed cash to be used as change for an event it would be in small bills - not the twenty dollar bills that you would receive at an ATM." Regarding the February 25, 2008, ATM withdrawal of $300, Volinsky stated that the AFN at that time of year did not have an event or party and couldn't understand why $300 was needed.
- Regarding the Roche Bros. and Donelans transactions, Volinsky and Greenland stated that both markets are "very generous to the AFN and often gave the AFN free gift cards."
- Volinsky and Greenland both were confused about the transactions from Supercuts and both pet stores and the American Girl transaction.
- According to Volinsky, the Ann Taylor Loft transaction for $76.52 was odd because Ann Taylor Loft has donated gift baskets to the AFN.
- Volinsky found the McDonalds purchases odd because the AFN never had events there and if they ever did hold an event there, the purchase would be much larger than $13.80.
- Both Volinsky and Greenland stated that the Lia Sophia jewelry party transaction was odd because they have no memory of this charge.
- Both Volinsky and Greenland thought the Oriental Trading Company transaction for $129.84 may be legitimate, as well as the Not Your Average Joe's transaction.
- Regarding the transaction $430.00 for the Kate Duffy-Business Dev. Firm, who Kimberly stated was the person who designed the AFN logo, Volinsky said the logo was done in 2007, so the transaction date of June 3, 2008 would not apply.
Kimberly Clark, 37, of 3 Paul Revere Road, Acton association officer embezzlement over $250 and larceny over $250 by single scheme - of larceny over $250 by single scheme and association officer embezzlement over $250, regarding her involvement as treasurer for Acton's Cub Scouts Packs 1 and 70. Her husband, Kevin is currently facing charges of larceny over $250 by single scheme.
Their pretrial will be held at the Concord District Court on Monday, July 18.
