Exchange Hall Tries for Premature Release of Funds
Exchange Hall wants its CPC funds released even though it has not met the conditions of the award as approved by Town Meeting and the CPC in 2008.

Acton Board of Selectmen heard from Exchange Hall owners on Monday, April 23, 2012, with a request to release $200,000 of their $231,000 Community Preservation Act (CPA) funding award, even though the conditions of the award have not been met.
The Selectmen decided to hold off on making a final decision until after the Architectural Access Board had issued its final report on the project.
The amount to be withheld--$31,000--had been approved by the Community Preservation Committee (CPC) in February, 2012, after being warned by staff that the CPC could "not ignore" Town Meeting votes.

"Roland Bartl reported that Town Counsel advises that since the conditions for releasing funds for the Exchange Hall project were voted at Town Meeting, we cannot simply ignore those requirements." (CPC Minutes, Feb. 16, 2012.)
Instead, the CPC voted to withhold just $31,000 of the $231,000 award, which they said would be "agreeable to Mr. Berger." (CPC Minutes, Feb. 9, 2012).

In fact, the Town Meeting warrant from 2008, in which the original award was granted, specified that "Payments shall be made after completion of all exterior and interior work items listed in the project funding application submitted to the Community Preservation Committee including all items funded by other sources." (See town website, Article 32, page 40)....
