Police Report for Acton Cub Scout Embezzlement Case

The following information was supplied by the Concord District Court. Where arrests or charges are mentioned, it does not indicate a conviction.

On November 3, 2011, Acton Police Detective, Christopher Browne, spoke with Satish Bhat (Acton Cub Scout Pack 1 treasurer) and William Gunthlin (Acton Cub Scout Pack 70 treasurer), who noticed some major discrepancies in their past financial transactions regarding their former treasurer from 2005-2009, Kimberly Clark. After a significant amount of evidence and interviews with both Kimberly and her husband, Kevin, Detective Browne determined that during Clark's tenure as treasurer of both Packs, she made various withdrawals from the Pack's checking accounts, which were made out to Kimberly, Kevin, and auto drafts for things like their electric bills.

Pack 70:

  • Thefts from Pack 70 began on Nov. 23, 2005, and concluded on April, 6, 2009 (47 checks were made).
  • The total amount believed to to taken from Pack 70 without proper authorization or justification was $19,127.70.
  • By January 12, 2012, Kimberly and Kevin had paid back $14,757.99 (leaving a difference of $5,114.91).

Pack 1:

  • Thefts from Pack 1 began on March 3, 2009, and concluded on July 29, 2011 (30 checks were made).
  • The total amount believed to to taken from Pack 1 without proper authorization or justification was $4,743.88.
  • By January 12, 2012, Kimberly and Kevin had paid back $3,415.09 (leaving a difference of $1,328.79).

On January 12, 2012, Detective Browne spoke with Kimberly Clark and her attorney, John McNamara, in the Acton Police station. According to the report, Kimberly acknowledged what her and her husband did was very wrong and they never had the intentions of stealing the money. The report says Kimberly said Kevin was the lone supporter of the family and went six months without a paycheck. She went on to explain they were behind on mortgage payments and their power and telephone services were shut off because they were behind on their bills.

Kimberly said the checks that were written to herself were to go to the grocery store because they "had no money." She said she used the Cub Scout account to pay National Grid to turn their power back on.

On January 12, 2012, Detective Browne spoke with Kevin Clark and his attorney, John McNamara, in the Acton Police station. According to the report, Kevin said they fully expected to pay the Cub Scouts back. The report says Kevin said it was not the right thing to do but thought it was a short term issue. Kevin stated that the money from the Cub Scout Packs were used to pay their bills.

Kimberly Clark, 37, of 3 Paul Revere Road, Acton, has been charged with larceny over $250 by single scheme and association officer embezzlement over $250 - .

Kevin Clark, 41, of 3 Paul Revere Road, Acton, has been charged with larceny over $250 by single scheme.

Their pretrial will be held at the Concord District Court on Monday, July 18.
