Judge Denies Bid to Halt Airport Construction
Wendy's owners will have to deal with ongoing road construction at Barnstable Municipal Airport.

Statement by Daniel W. Santos, Chairman of Barnstable Municipal Airport Commission
I welcome a significant decision handed down Wednesday in Boston by state Land Court Judge Gordon H. Piper. Judge Piper failed to grant an injunction sought by the owners of the Wendy's property in Hyannis to stop construction at the airport because of their pending lawsuit.
The decision affirms that the airport commission and staff followed the
permit conditions for the new air traffic control tower, passenger terminal and access road. We will continue to defer road work near the Airport Rotary and along Route 132 pending final resolution of legal action.
We look forward to opening the tower and terminal this fall and completing road work as soon as possible.
