Child Endangerment, Drug Charges For Brockton Woman

Police said they found Percocet and Xanax inside the same car as the one-year-old child.

TAUNTON, MA — A Brockton woman was arraigned in District Court Tuesday after police said they found her one-year-old child in a car containing Percocet and Xanax pills. A Taunton man was with the child in the car registered in the woman's name.

Marily Ann Ruth, 36 was charged with reckless endangerment of a child, as well as class B and E drug possession. Justin Higgins, 37 was charged with Class E drug possession, disorderly conduct and interfering with a police officer.

According to police, they were called to Higgins's apartment because of someone calling reporting a drug overdose. The man the caller said was overdosing gained consciousness and ran away. He lost consciousness again and needed to be revived. That man was identified as Thomas, Ruth, 32, of Brockton, Marily Ann's husband.

Police questioned Marily Ann while she was standing next to her vehicle and Higgins who was in the car with the child. When Higgins was asked to step outside, police said they saw an orange bottle of pills and that Xanax and Percocets were found in the car.

The child was taken to Morton Hospital in Raynham and was placed in the care of emergency room staff, while the he Department of Children and Families.
