Dog Owners File Appeal Of Danvers Selectmen's Decision In Court

A lawyer for the dog owners say selectmen over-stepped their authority.

DANVERS, MA -- Sabrina and Trung Nguyen filed an appeal of a decision on their dog by the Danvers Board of Selectmen in Salem Superior Court on Dec. 10. The couple had been scheduled to appear before selectmen on Tuesday to discuss the decision with selectmen. The Nguyens have been named in a complaint after Neeka, their seven-year-old pit bull, attacked a goldendoodle named Henry on July 12.

Danvers Police Chief David Ambrose had made a recommendation and selectmen had added additional restrictions, including that the dog only be let outside when it was under the owners' leash control. Ambrose had recommended that the dog only needed to be leashed when it was outside and could be tied up in the couple's backyard.

"The board illegally issued its own decision on what remedies to put in," the Nguyen’s lawyer, Jeremy Cohen, told the Danvers Herald, which first reported this story. "They weren’t the hearing authority. The board was over the top with punishing my client. They can’t make an unconstitutional order."
