Pair Charged With Rape of Teenage Girl in Danvers

A Florida man and Danvers woman are facing charges of statutory rape for alleged sexual assaults two years ago when a teenage relative of the woman stayed with her during school vacation week.

A Florida man and a Danvers woman are accused of raping a female teenager in the woman's home two years ago and are now facing charges in that case in Salem District Court.

Luis Rivera, 46, of 5222 Sunset Canyon Dr., Kissimmee, Fla. was arrested by state police Friday afternoon on a warrant from the Danvers Police Department. He was then arraigned on Monday on one count of aggravated rape of a child.

His alleged partner in the sexual assault and former girlfriend -- Gaudy Asenjo, 34, of 13 Walcott Rd., Danvers -- was arraigned April 8 on the same charge. Rivera and Asenjo both pleaded not guilty. The victim, who was 14 at the time, is a relative of Asenjo's.

District Attorney's office spokeswoman Carrie Kimball-Monahan said Rivera was held on $75,000 cash bail and ordered to stay away from and have no contact with the victim.

She said Asenjo was held on $10,000 cash bail last month and likewise told to stay away from the victim and have no contact with her.

Their next court date is June 5 for a probable cause hearing.

The Salem News reports that the sexual assaults allegedly occurred while the girl was staying with Asenjo over school vacation week in February 2011.

The victim told police Asenjo allowed her to drink and smoke marijuana in the house, and at one point bragged about the sexual abilities of her then-boyfriend (Rivera), telling the girl he could do the same to her, reports the Salem News.

The victim claims Rivera engaged in sexual acts with her during that week and that Asenjo joined in at times. The girl and her family finally reported the alleged abuse to police this past January.

The Salem News also reports that Asenjo told police the sexual acts were consensual between Rivera and the girl, but denied she [Asenjo] had any role in that.
