Suspect In Fatal Dedham Robbery Won't Face Murder Charge, Arraignment Moved To Friday

DEDHAM, MA — A Roslindale man charged in a fatal robbery will not face a murder charge he was indicted on but will face other charges related to the 2016 incident.

Nicholas Durfee, 36, appeared in Norfolk Superior Court in Dedham Monday afternoon for what was scheduled to be his arraignment. During the brief hearing, the Norfolk County District Attorney's office requested a nolle prosequi for the murder charge, meaning that they will not prosecute the charge.

Durfee's arraignment was moved to Friday afternoon because he is expected to challenge the $100,000 he was ordered held on during his district court arraignment last year.

On May 27, 2016, Durfee allegedly broke into the Upland Road home of an 89-year-old man. After the incident, the injured resident managed to gain the attention of two people passing by and asked them to contact police. Prosecutors say the victim died from injuries sustained in the robbery.

Durfee faces charges of unarmed assault to rob, assault and battery on a person over 60, and breaking and entering in the daytime to commit a felony.
