2 Retired Falmouth Cops Sue Man Accused Of Shooting Them

Prosecutors said Malik Koval shot officers two Falmouth officers​. His mother and brother are also accused of interfering with police.

FALMOUTH, MA — Two retired Falmouth police officers filed a lawsuit against a man accused of injuring them in a 2018 shooting.

Former officers Donald DeMiranda and Ryan Moore, both of Falmouth, filed the complaint against Malik Koval, 23, of East Falmouth, and his family on July 16. The former officers are seeking $300,000 in lost wages and another $500,000 for anticipated lost wages, the complaint read.

Koval is facing several counts of assault and battery and other charges stemming from the July 2018 shooting. He pleaded not guilty, and his lawyer Brian Kelley, has argued one of the officers accidentally shot the other while Koval ran from police, the Cape Cod Times reported. Koval's trial date is scheduled for Nov. 15.

DeMiranda and Moore's attorney Paul Johnson, also filed an amended complaint Thursday, which accused Koval's mother Kimberly Koval and brother Marcus Maseda of interfering with the officers' attempts to apprehend Malik Koval.

The shooting happened after DeMiranda and Moore went to Malik Koval's home on Ashley Drive to investigate a report of disorderly conduct, the complaint read. Malik Koval became agitated when the officers confronted him after they received a call about a man breaking bottles in the street, according to police.

According to the complaint, Malik Koval was "behaving erratically and speaking incoherently," when confronted. He ran away into his backyard when DeMiranda and Moore tried taking him into custody, the complaint read.

When the officers chased Malik Koval, Kimberly Koval and Maseda interfered with the pursuit, as their family member ran into his house to grab a gun, according to the complaint. The complaint also accuses Malik Koval's family of delaying the officers' attempts to enter the home.

"Every person has a duty to refrain from interfering with the lawful actions of the police," the complaint read. "Defendant Kimberly Koval breached that duty when she negligently interfered with the efforts of the police officers to take Defendant Malik Koval into custody."

Malik Koval then fired a gun and seriously injured the two officers, the complaint read. DeMiranda suffered a gunshot wound to his left shoulder and required surgery, while Moore was shot in the neck.

"As a direct and proximate result of the battery by Defendant Malik Koval, Plaintiff Donald DeMiranda sustained personal injuries, incurred loss of earning capacity and loss of wages, and suffered other damages," the complaint read.
