Falmouth Board Files ZBA Lawsuit Taxpayers Gouged Again
Mass Clean Energy Center failed due diligence put state renewable energy goal ahead of health and property rights - Taxpayers Pay Again

In 2015 the Massachusetts Court of Appeals overturned Barnstable Superior Court Judge Robert Rufo’s June 2013 decision in favor of the Town of Falmouth.
The Massachusetts Court of Appeals ruled in favor of the wind turbine victims who complain of a noise described as torture from lack of sleep.
The neighbors sued the town over its 2009-2010 installation of Wind 1, one of the twin, 1.65-megawatt wind turbines erected at the town’s wastewater treatment facility.

The victims argued that the town’s zoning bylaws required a special permit 240-166 for the turbines. The court agreed.
The Falmouth Zoning Board of Appeals recently ruled against giving a special permit to Falmouth Wind 1. The turbine has been out of operation since October of 2015.

The Falmouth Select Board tonight decided to take the Zoning Board of Appeals decision back to court.
This makes ten active lawsuits over the wind turbines.
The litigation fees are up to as much as $300,000.00 every six months.
The Town of Falmouth can not get out of their newly renegotiated renewable energy credit agreement with the Massachusetts Clean Energy Center unless of a court order. The town renegotiated its REC agreement in 2014.
The Massachusetts Clean Energy Center formerly the Massachusetts Technology Collaborative provided faulty acoustic noise tests prior to the installation of any turbines.
