Falmouth: Downfall of Megawatt Wind Turbines Massachusetts

Ten Years We Watched A Failed Health & Financial Wind Turbine "Agenda." The Next Ten Years We Will Witness Removal Of Tortourus Noise

The Town of Falmouth starting in August of 2007 started seeing the start of big financial problems. By the end of 2008 the whole country was in a financial crisis as well as many residents in Falmouth.

The Massachusetts Technology Collaborative today the Massachusetts Clean Energy Center offered the Town of Falmouth commercial megawatt wind turbines as a means of an ongoing revenue stream forever. The Select Board and Energy Committee looked at the turbines like a new rush for gold. The entire town went for eating the candy and paying for it later and brothers and sisters they are paying plenty today with their health and multiple lawsuits

The wind turbines considered a good item has a bad side, and several of these factors started to emerge alongside one another from the day they turned on the turbines. The neighbors started complaints about a noise described as torture because of the lack of sleep and shadow flicker from the blades passing through the sun.

The Town of Falmouth today has ten ongoing lawsuits with no end in sight and spending up to $300,000.00 every six months for litigation. The town recently filed another lawsuit in Massachusetts Land Court. The initial hearing to start the case against its own Zoning Board of Appeals on June 8th could quickly be thrown back into Massachusetts Superior Court where it started several years ago.

The Town of Falmouth may soon face a Special Town Meeting to request more litigation fees. In addition the recent Falmouth town elections may end up in Barnstable Superior Court. The next Town Meeting is in November.

The " Friends of Falmouth Wind " made up of a group well positioned people in Falmouth town government want to operate the wind turbines 24/7 despite the noise and health warnings by the manufacturer of the turbines Vestas wind company.


The " Friends of Falmouth Wind " began by demanding that the wind victims leave Falmouth, and then attempting to take away their legal rights if they didn't go. It's a well known fact the "Friends" want the victims out of all government positions, for example. The "Friends" now today want their own members appointed to local boards.

The big problem for Falmouth today is the state of Massachusetts has quietly dropped its land based wind turbine renewable energy agenda and switched to Solar. There are no longer any state officials or editors of the news media that want to be associated with the health problems and ongoing litigation over property takings.

You could very well say Falmouth is being left out to dry by state officials . The only thing left is to negotiate with the wind turbine victims. At this point why would the victims negotiate with the town after all the town has reneged on past agreements and carefully hid noise warnings, documents, memos and studies over the past six years.

Falmouth Wind I will never spin again. Falmouth Wind II is headed in the same direction. The town failed to file Special Permit 240-166 because it would require additional abutter notifications and studies.

The Town of Falmouth is hanging its hat on the Latches Doctrine for Falmouth Wind II.

The Latches Doctrine is a legal common law defense action that bars recovery by the plaintiff because of the plaintiff’s undue delay in seeking relief. Aka the victims did not file their lawsuit on time for Falmouth Wind II.

The Latches Doctrine is a legal common law defense action only if the town followed all local and state laws.  In this case the town illegally placed the wind turbines and hid memos, documents and letters to avoid abutter notifications.

The problem for town officials is why did they hide the August 2010 noise warning from the manufacturer of the turbine Vestas wind company and failed to file Special Permit 240-166 ? The answer is obvious that the Special Permit process would have required addtional abutter notifications and the noise warning letter if made public would have stopped the installation of Falmouth Wind II.

The attorneys representing the Town of Falmouth by now should have asked town officials to negotiate with the neighbors. The " Friends of Falmouth Wind " aka the town officials will only negotiate a deal in which the victims lose.

The wind turbine victims have won every legal case in the last six years. The town may give the victims three choices A B or C . For the record the answer to a multiple choice negotiation is D none of the above.
