Between 2010 and 2012 the Town of Falmouth built two foreign made Vestas V 82 megawatt type 1.65 megawatt turbines. General Electric a domestic wind turbine company refused to build even a single megawatt turbine because of residential setbacks and ice throw.
The Massachusetts Clean Energy Center financed the wind turbine studies and was also the owner of several Vestas wind turbines that couldn't be sold at auction.
The MassCEC was aware of two distinct types of noise from the wind turbine "regulatory" and "human annoyance." The MassCEC was aware from studies done in 2005 the turbines would break state noise guide lines and extrapolated the figures. The MassCEC was aware in a warning letter from Vestas that the turbines exceeded the 2005 noise study using a smaller GE turbine.
The MassCEC was aware high quality work by US scientists in the 1980s uncovered a wind turbine sound profile (signature) that included infra sound and low frequency sound (ILFN).
In 2012 citizens held the Falmouth Conference on Human Rights. The topic was "Freedom from Unwarranted Experimentation."
The Massachusetts Clean Energy Center has accepted human rights abuse to reach a political goal of 2000 megawatts of renewable energy by the year 2020.
The Massachusetts Clean Energy Center in its studies is guilty of cruel, inhuman and degrading treatment of wind victims. The agency discriminated against the wind turbine victims by providing 1.8 million dollars in a new renewable energy agreement between 2013 and 2014 to the Town of Falmouth. The MassCEC is financing the town litigation costs with tax money from the renewable energy trust.
The wind victims are being legally out spent in an elaborate scheme to use the court system to obfuscate the noise described as torture from lack of sleep.
Wind turbine victims worldwide describe the noise as a type of torture from lack of sleep leading to other health problems.
Falmouth victims have been subjected to physical and mental health issues for over six years. The turbines have affected home ownership and other assets. Any one of rights breached is enough to trigger the obligations of the Human Rights Commission.
The Massachusetts Clean Energy Center is using an expensive campaign of using a platoon of attorneys to use the Massachusetts court system to stall the rights of the victims to reach the renewable energy goals by the year 2020. The campaign of denial and spin is being financed by the taxpayers of Massachusetts
The recent denial of a Special Permit for Falmouth Wind I by the Falmouth Zoning Board of Appeals in an 38 article finding proves the impact on residents constitutes multiple transgressions of their human rights.
