The Falmouth Zoning Board of Appeals denied a special-permit application for one of the town's twin wind turbines in April of 2016. The Massachusetts Appeals Court ruled in 2015 that the Falmouth wind turbine should have received a permit before it was constructed.

The town remains fractured over the wind turbines. A minority of residents suffer from a noise described as torture and illegal property takings while the majority of residents have put a monetary value on the health of their own neighbors.
The Falmouth Select Board has filed litigation in Massachusetts Land Court starting June 8, 2016. The court case could take two years and then be appealed again to the Massachusetts Appeals Court. The town is already spending up to $300,000.00 every six months on litigation.

The town hid a noise warning letter from the turbine manufacturer, an April 2005 feasibility study, 2013 April memo from Massachusetts Clean Energy Center and never filed Special Permit 240-166 because it would have required additional studies and abutter notifications.
This is like, when somebody lies or steals, and people get to know that person or politician as a liar or a thief, it takes infinity to get people's trust back, even if the town officials quit doing it.
The filing of the litigation in Massachusetts Land Court June 8, 2016 has ended any hope of reconciliation and attempts to put Humpty Dumpty back together have failed over and over again.
