Falmouth MA - Political Agenda pitched against Community's Charter

Selectmen Agenda Wind Turbine Topic Out-Of-Bounds

Appearing on the Falmouth Board of Selectmen’s March 30, 2015 agenda is a violation of the town’s charter. Selectmen are to permit the Town’s Manager, according to agenda, to exectute agreements with Mass Clean Energy Center regarding:

a. Unplanned Maintenance Grant (Wind 1 and Wind 2)
b. Amended Renewable Energy Certificate Purchase Agreement (Wind 1)

According to Town Home Rule Charter “Consistent with any constitutional or statutory provision, the Town of Falmouth may exercise any of its powers, or perform any of its functions, and may participate in the financing thereof, jointly or in cooperation, by contract or otherwise, with any one (1) or more municipalities, civil divisions, subdivisions or agencies of the commonwealth, other states or the United States Government.

Begging the question - is Falmouth’s Board of Selectmen within its authority to permit a contract involving municiplal financing with MCEC (an agency of the commonwealth) when constitutional and statutory authority is pending the Commonwealth’s high court’s determination?

It would seem, despite fiduciary accountability requirements, Town Charter trumps, therefore making the attempted agenda item void.
