For years every time it gets close to court the select board offers mediation only to balk after the court dates

Legal ethics questioned a third time Falmouth Select Board proposes intentional unethical mediation methods.

First in 2012 the Consensus Building Institute CBI was paid just under $139,000.00, for an assessment; designing and convening the process; preparing for, traveling to, facilitating and documenting 24 meetings (including all expenses); and writing and revising a final report, over the course of 13 months. The purpose of the Falmouth Wind Turbine Option Analysis Process (WTOP) was to engage in an open, transparent, and collaborative exploration of the range of options for the long-term future of the Town’s two Wind Turbines – Wind I and Wind II.

The Falmouth Select Board defense strategy of stalling for years has now created a toxic environment with 200 residential homes. These homes around the turbines to some degree are all suffering real estate devaluation after waiting 6 years hoping they can run out the clock

The Select Board bad faith bargaining and filing lawsuits against itself has created a legal minefield

200 Residential Homes In Toxic Neighborhood :

WTOP CBI Conclusion Page 48 : "If the Turbines remain in operation, it is likely that the property value issue will then begin in earnest and may only be resolved in court. If the Selectmen buy-out homes of health affected neighbors, the larger area encompassing 200+/- properties will become a toxic neighborhood, which may be the negative tipping point for their property values and fuel fair compensation? The arithmetic will not be tricky to prove by then and the conflict will hurt the town’s finances and image for decades. This is just the beginning of calculating the total costs for the Wind Farm."

During these negotiations the Town of Falmouth intentionally hid a 2010 noise warning letter from Vestas wind company that the turbines were dangerously loud.
On November 7 of 2013 Town counsel Frank K. Duffy and former select board member Rebecca Moffitt, representing the town of Falmouth , came to an agreement in Barnstable Superior Court . Barnstable Superior Court Judge Christopher J. Muse was the judge in the wind turbine case.

One week later the Falmouth Select Board rejected the agreement saying it was not binding because it was not it writing.

These November 2013 negotiations marked the second time mediation was attempted.
The court then ruled the defendants, wind victims, in the case face “a substantial risk (that they) will suffer irreparable physical and psychological harm from the turbines.

The town intentionally hid a 2010 noise warning the turbines are dangerously loud.

The wind turbine victims private lawyers on the other hand have to play by the rules and have a long-term career, earning the respect of their clients, their colleagues, judges and their families. Playing by the rules means respecting the truth .There is no room for lawyers who try to deceive.

Monday July 25, 2016 as the Town of Falmouth faces eleven ongoing lawsuits over the turbines the Falmouth Select Board has again requested a “global solution” to the wind turbine health and financial fiasco.

The conclusion :

The Town of Falmouth hid a noise warning letter from Vestas wind turbine company.

The letter spelled out that the turbine was twice as loud as a General Electric turbine used in a 2005 study.

The 2005 study map showed decibels levels over 40 decibels at property locations would be increased to near 50 decibels.

The town intentionally took the health and property rights of up to 200 residential home owners for a political agenda and the dream of an unending revenue source.

The result today eleven lawsuits, lost health and property rights and up to $300,000.00 every six months in litigation costs.
