Bad legal advice to the town of Falmouth has led it from the frying pan into the fire. Taxpayers are being slowly boiled like frogs on the flames.
At Special Town Meeting meeting on Tuesday night November 10, 2015, the Falmouth Board of Selectmen beat a hasty retreat under withering fire from their outrageous proposal to evade the judgement of the Supreme Judicial Court by exempting Wind 1 and Wind 2 retroactively from the requirement to obtain a special permit -- six years after installation.
The Planning Board had previously rejected the Select Board proposal by voting unanimously for “indefinite postponement” of Article 3 on the warrant at the special town meeting Tuesday night, with harsh criticism of the impropriety of this action by the Selectmen.
Now, in order to avoid the further embarrassment of having the Planning Board and members of the public excoriate the Select Board from the floor of the special town meeting for such unscrupulous conduct, the Selectmen have capitulated by voting to support the Planning Board’s recommendation of indefinite postponement, saying that their own proposal requires “additional study.”
Article 3 was proposed after town legal advisors apparently became emotional and distraught over a presentation by an attorney for the wind turbine victims on September 17. The Town of Falmouth has suffered bad legal advice since before the illegally permitted turbines started to spin in 2010.
Taxpayers need to question the six years of bad legal advice.

“ARTICLE 3 : To see if the town will vote to amend Chapter 240- Zoning-of the Code of Falmouth by adding the following to Article XXXIV (34) Wind Energy Systems: 240-166.D (2) Any Wind Energy System owned by the Town of Falmouth and used for municipal purposes, in existence as of the date of this bylaw, shall be exempt from the provisions of this Article, pursuant to Section 240-30.B. and may be allowed to operate as a of right in public use districts.”
