BOARD OF SELECTMEN AND TOWN OF FALMOUTH ARE CLAIMING TOWN OF FALMOUTH HAS THE RIGHT TO HARM ITS OWN CITIZENS, FOR ITS OWN FINANCIAL GAIN.
The Falmouth Select Board is going to present an article to a Special Town Meeting November 10, 2015. The article is going to ask Town Meeting Members to add an amendment to the wind turbine bylaw consistent with Article XXXIV (34).
The amendment will ask Town Meeting Members that the town accept the two illegally installed wind turbines with no permits. Another rush to judgment why not just tell the public the truth. The town hid all the negative documents from Town Meetings Members and now they are doing it again !
Town Meeting Members are going to be asked to vote an amendment to bylaws that are in litigation.
Approval of the Attorney General is required when town by-laws are adopted or amended. November 10, 2015 the turbines will not have a Special Permit # 240-166. How could the Attorney General approve something in legal limbo ? What is the Select Board thinking ?
Legally the turbines do not exist they are illegal.
The Falmouth wind turbines are costing the taxpayers more and more money every year. A vote on November 10 to accept two illegal wind turbines will surely enhance more ltigation for the foreseable future. The only ones making money here are the attorneys.
The Supreme Judicial Court has ruled the turbines were installed illegally in June of 2015.
The Falmouth Select Board is going to ask Falmouth Town Meeting Members to vote on the two turbines in the midst of litigation and court ordered mitigation from 2013 ?
In 2013 a Barnstable Superior Court judge ordered the town of Falmouth to limit the operation of two, town-owned wind turbines, including shutting them down completely on Sundays and holidays. The order came as Judge Christopher Muse still considers complaints from some neighbors that noise from the turbines at the town’s wastewater treatment plant causes health affects, including insomnia, headaches and vertigo.
The Select Board is aware the turbines break state noise laws and regulations. There are lawsuits lined up out the front door of town hall. How many more lawsuits can the town afford for two turbines that break state noise laws ?
The legal fees at $600.00 plus per hour are going to exceed the purchase price of the turbines !
The Town of Falmouth and the Massachusetts Clean Energy Center have always been aware the turbines break the law. The notes are at the bottom. The memo admitting “mistakes” in noise tests and the hidden noise warning letter from Vestas Wind Company in 2010.
Falmouth Had Five Years To Conduct Health Studies To Date Not One Wind Turbine Victim Has Been Examined.
Why did they hid the negative information ? Ask for the truth.
